Agreement to These Terms

This Terms of Use Agreement (“Terms of Use”) applies to your use of the Brown Metals Company website at www.brownmetals.com (the “Site”). The Site is the property of Brown Metals Company (“BMC,” “we,” “us” or “our”). By using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.

Changes to These Terms

BMC may change, add to or remove portions of these Terms of Use at any time, at its sole discretion. The “Last updated” date at the top of this page shows when they were last revised. It is your responsibility to review these Terms of Use each time you use the Site. Your continued use of the Site after changes are posted means you accept them, and all later use of the Site is governed by the Terms of Use in effect at that time.

Permission to Use the Site

As long as you comply with these Terms of Use, BMC grants you a personal, non-exclusive, non-transferable, non-sublicensable, limited privilege to access and use the Site. You agree not to:

• use the Site for any unlawful purpose or in violation of these Terms of Use;
• attempt to gain unauthorized access to the Site, its servers or any connected system;
• interfere with the Site’s operation, including by introducing viruses or other harmful code, or by placing an unreasonable load on it; or
• copy, scrape or republish Site content in bulk, except as permitted below.

Technical Information

The Site includes technical information such as alloy technical data sheets, the Specification Cross Reference, the Stock List, Metals 101 articles, terms and abbreviations, hardness conversions, mechanical and chemical properties, and weight, footage and conversion calculators. This information is provided for general reference only.

• Values are typical, or are specification minimums or maximums where noted. They are not design limits and are not a guarantee of the properties of any particular lot of material.
• Specifications are revised over time. Always refer to the current revision of the applicable specification.
• The certified test reports and certificates of conformance supplied with each order are the record of the material actually shipped.
• BMC does not recommend materials for specific applications. Selecting a material for an application is the responsibility of the purchaser.

Quotes, Orders and Stock Information

Stock information, prices, surcharges and availability shown on or through the Site are for reference and may change without notice. They are not an offer to sell. Quotes and orders are governed by the terms stated on BMC’s quotation and order acknowledgment.

Intellectual Property

The content of the Site, including text, tables, data sheets, photographs, videos, graphics and the Brown Metals Company and Sidecuts® names and logos, is owned by BMC or used with permission, and is protected by copyright and trademark law. You may view, print and download Site content, including technical data sheets, for your own internal business use, provided you do not alter it or remove any notices. Any other use requires BMC’s prior written permission.

Linked Sites

The Site links to other sites, including BMC’s customer forms and document library at forms.brownmetals.com, the invoice payment site at invoice.bmcpay.com, and BMC’s online store, Sidecuts®.com, which has its own terms and policies. The Site may also link to sites operated by others, such as YouTube. BMC is not responsible for the content or practices of sites operated by others, and a link does not mean BMC endorses them.

Use at Your Own Risk

Use of the Site is at your own risk. BMC assumes no responsibility or liability for damage to computer equipment or software, from viruses or otherwise, resulting from accessing the Site or downloading anything from it.
